Helford River Seasonal Rental Agreement

As granted by HP Marine, who retains the right to refuse any application of a Seasonal Rental Agreement if they feel that the vessel is not suitable for the mooring.

This Seasonal Rental Agreement is made between us to commence on April 1st or Good Friday, whichever comes first. Between HP Marine of the one part and the addressee (Herinafter called ‘The Hirer’) of the other part.

Terms and Conditions

For seasonal renting of a mooring in the Helford River area as granted by HP Marine:

1. The Hirer is granted the use of this mooring:

a) Providing that it has been serviced for the current year,

b) From April 1st or Good Friday, whichever is the earlier to October 31st

c) For the personal use of The Hirer,

2. Payment

a) Payment should be made when HP Marine have accepted your application and no later than 7 days after receipt of this agreement or by 1st January, whichever is the later.

3. The Hirer will fully insure the vessel, with a reputable company and produce a certificate of the insurance if requested for 3rd party liability and will indemnify HP Marine, its Officers and its Agents against all claims whatsoever, which might arise as a result of the granting of this Agreement.

4. The Hirer, having confirmed with HP Marine that the mooring allocated to them has been serviced, will ensure that when the vessel is attached to the mooring, it is at all times securely fixed to the Riser chain of the mooring, by the Pickup chain supplied. The Hirer may not change or interfere with any of the equipment attached to it nor lengthen in any way, the length of the connection between the mooring riser chain and the bow fairlead unless written permission has been gained from HP Marine on an annual basis.

5. The Hirer will accept that while the distance between the moorings is so calculated as to provide the best opportunity for a clear swinging room for the vessels authorised to occupy them under normal circumstances, there may be circumstances where wind, tidal or meteorological conditions may allow for vessels to come into contact with other vessels or mooring buoys and associated equipment and damage may occur. The Hirer agrees to indemnify HP Marine, its Officers and its Agents against all claims for damage so caused to or by their vessel.

6. HP Marine and its Agents will not be held liable for any damage to equipment or vessels using their moorings in winds of gale force or above.

7. HP Marine and its Agents reserve the right to move the mooring if it is laid in the wrong position or if the vessel is fouling or interfering with another. The Hirer will not move the mooring in its geographical relationship with others.

8. HP Marine and its Agents reserve the right to move The Hirer’s vessel to another mooring or re-allocating The Hirer another mooring for reasons of safety or good management of the moorings.

9. This agreement shall be personal to The Hirer or spouse and is assignable only with the written consent of HP Marine or its Agents.

10. The Hirer shall not permit any other vessel to be attached to the mooring without the written consent of HP Marine or its Agents.

11. The Hirer shall inform, in writing, HP Marine or its Agents immediately of any changes in the registration details applicable to the vessel. No refunds will be given once the fee has been paid.

12. The Hirer shall not use the vessel mentioned in this Agreement for the purpose of any trade or business without first obtaining written consent from HP Marine or its Agents.

13. The Hirer will display, in full view, the authorised display sticker on the starboard side or stern of the vessel if requested to do so.

14. On the expiration of the Agreement, The Hirer shall remove the vessel immediately from the mooring. Failure to remove the vessel under these circumstances shall result in HP Marine or its Agents having the right to charge The Hirer for the time after the expiration date at the average Visitor mooring rate or to remove the vessel and recover the costs of doings so from The Hirer.

15. If The Hirer shall fail to perform or observe any of the Terms and Conditions of this Agreement, HP Marine or its Agents shall be entitled to determine it forthwith.

16. HP Marine determines the right to employ Agents to act on its behalf.
